Terms & Conditions of Purchase

These Terms and Conditions of Purchase do not affect your statutory rights as a consumer.

1. Acceptance of Offer to sell your prestige vehicle

  • To sell your vehicle to us, you must visit our website at webuyprestigecar.com, email us on [email protected]
  • You will be required to provide us with certain information about the type and condition of the vehicle you wish to sell. We will then provide you with a price we would be willing to pay you for your vehicle (subject to these Terms and Conditions of Purchase).
  • If you are then happy with the price quoted, you may then make an offer to sell your vehicle to us at the agreed price. You will be asked to reconfirm the details that you provided in relation to the vehicle and we will acknowledge receipt of your Offer.
  • After considering your Offer we will let you know if we have accepted it. Our acceptance of your Offer creates a binding contract between us. If we decline to accept your Offer we will give you a reason for our decision.
  • Upon acceptance of your Offer, you will receive a Purchase Contract for your vehicle. This Purchase Contract will contain full model description and details of the vehicle, including details on its condition that you provided and upon which the quoted price is based. You will be required to confirm these details are entirely accurate as indicated on the acceptance form; these details are then to be abided by throughout the sale and purchase process. Your Purchase Contract will then be sent, to our Transport Team, who will call you to arrange collection of your vehicle. Both Acceptance of the Purchase Contract and Terms and Conditions (detailed herein) will form a Legally Binding agreement between you, the Seller and webuyprestigecar.com, a subsidiary of Prestige Vehicle Buyer Limited. If your vehicle does not qualify for collection, then you will be required to deliver your vehicle to one of our agreed designated drop-off points.
  • We will ask to collect your vehicle at an agreed address (in mainland England, Scotland or Wales) that you provided when offering your vehicle or you may deliver to us at one of our designated drop-off points as agreed in your Purchase Contract.

2. Prices Quoted by Us

  • Quoted price is in Pounds Sterling and is inclusive of VAT at standard United Kingdom rate, where applicable. You are responsible for the disclosure and payment of any duties or other taxes which apply. Our VAT number is GB230833433.
  • Whilst every effort is made to ensure all prices provided are accurate, errors can sometimes take place. If we discover an error in the price we will contact you as soon as possible and give you the option of either reconfirming your Offer at the correct price or cancelling it. If we are unable to contact you, we will treat the contract as being cancelled.
  • Subject to our condition checks and these terms and conditions, prices quoted are set at the point of quotation for a period of 14 days and cannot be amended, supplemented or replaced by any other quotation for the vehicle obtained through the quoting tool on this website.
  • All prices quoted in the valuation are given in good faith, being derived from a combination of factors including the information supplied by the Seller. The provision of inaccurate, false or misleading data by the Seller will result in an inaccurate valuation which cannot be relied upon by the Seller and we reserve the right to amend or withdraw the valuation accordingly.
  • All prices quoted are subject to a current daily valuation data. In the event that subsequent daily data be made available to us prior to / at the point of purchase, we reserve the right to amend the valuation accordingly.
  • Any significant increase in mileage to the vehicle from the date the valuation to the date of collection / delivery of the vehicle by / to webuyprestigecar.com will result in the valuation provided being incorrect. A revised valuation may therefore be required and we reserve the right to amend the valuation accordingly. A significant increase is defined as five hundred miles or over.

3. Payment

  • We will pay the agreed price by sending the funds electronically to your nominated bank account by bank transfer at time of collection. Alternatively, we can present you with a banker’s draft*, company cheque or, in certain circumstances, cash*, when we collect the vehicle (*charges will apply)

4. Your Warranties

  • The Seller expressly warrants they are the legal owner of the vehicle and that all the information supplied during the valuation process is accurate and true.
  • The Seller warrants that the vehicle is not subject to any undisclosed finance.
  • The Seller warrants that, to the best of their knowledge and belief, the vehicle has not been an insurance write-off or has been involved in any other serious accident that required substantial remedial repairs.
  • The Seller warrants the mileage reading on the vehicle is accurate and true, and that the odometer has not, to the best of their knowledge and belief, been tampered with.
  • The Seller warrants that there are no undisclosed physical defects with the vehicle that a purchaser would want to be informed about (including, but not exclusively, accident damage/repair, mechanically unsound or inoperable, unroadworthy and/or chassis damage).
  • The Seller warrants that there are no undisclosed "title defects" with the vehicle that a purchaser would want to be informed about.
  • The Seller warrants that he is the legal owner of the vehicle, has the right to transfer the full unencumbered legal title and full ownership.
  • The Seller warrants that no other person has any claim to the vehicle whether legal, equitable, possessory or otherwise.

5. Complaints and Liability

  • We, our directors, employees and other agents shall not be liable for damages of any kind including and without limitation, direct, indirect, special or consequential damages, loss of income or profits, loss of or corruption of data, loss of or damage to property or claims of third parties, arising out of or in connection with our purchase of the vehicle or our late or non-collection of the Vehicle. In any event and subject to the paragraph below, our total liability to you will never exceed the price.
  • We do not limit or exclude our liability for death or personal injury caused by our negligence or any rights you may have as a consumer to the extent that such liability and rights may not be limited or excluded under applicable law.

6. Call Out and Cancellation Policy

  • An administration charge of £95 plus VAT will become payable immediately if, having accepted our Purchase Contract relating to the purchase of your vehicle, it is decided not to go ahead with the sale of your vehicle. This administration charge covers our costs associated with DVLA vehicle checks, Experian/HPI reports, finance and import investigations, call charges and relevant paperwork.
  • A cancellation charge of £195 plus VAT, plus any associated un-recoverable costs, will become payable should you cancel the collection of your vehicle once our Agreed Collection email has been sent from our Transport Team. This charge should be paid within 7 days from the date of invoice.
  • A minimum call out charge* of £295 plus VAT (* dependent upon collection location), plus any associated un-recoverable costs, will be payable in advance for all collections. If at the point of collection, it is discovered that the vehicle is not entirely as described in the Purchase Contract, and an amended price cannot be agreed by both parties, this charge then becomes payable immediately in cash or by debit/credit card.

7. Vehicles subject to Finance

  • It is the responsibility of the Seller to disclose to webuyprestigecar.com any existing finance associated with the vehicle.
  • At its absolute discretion, webuyprestigecar.com may agree to settle the existing finance in lieu of payment (or part payment) of the vehicle to the Seller.
  • If any finance settlement figure is lower than the purchase offer, we will pay to the seller the difference between the two figures. The finance will be cleared simultaneously with the collection of the vehicle and followed up by us until we have received confirmation that there is no further financial interest in the vehicle. Financial markers against the vehicle may not clear at the same time as the finance is cleared and so may still be visible for a short period after collection despite the clearance of finance.
  • If the agreed purchase price of the vehicle is lower than the settlement figure required to fully settle any related finance, the Seller must pay webuyprestigecar.com the difference between the settlement figure and the agreed purchase price, by cleared funds, in advance of webuyprestigecar.com settling the outstanding balance on the finance. Failure by the Seller to pay such a sum by the point of collection will automatically render the contract between the parties terminated, and any payments as outlined in our cancellation policy will come into effect.
  • The Seller remains fully liable to the finance company in respect to the related finance at all times, until the credit agreement against the vehicle has been legally terminated. webuyprestigecar.com does not accept any liability with respect to the related finance at any time, or for any reason.
  • Evidence of the finance settlement payment being made by us will be provided to you at the point of the collection of the vehicle, however, lenders may take up to 48 hours to reconcile the settlement payment and clear your finance account.
  • webuyprestigecar.com will use its best endeavours to pay the settlement sum before or on any due date. However, no liability is accepted if payment cannot be made by the due date due to unavoidable circumstances.

8. Collection By, or Delivery To, Us

  • If you have agreed to deliver the vehicle to us, you shall deliver it on the date agreed. If you have asked us to collect the vehicle, we will give you an estimate of the time we will collect it. We will endeavour to collect the vehicle within one hour of the time we give you for collection, but this will be an estimate and will not form part of any contractual obligation.
  • Subject to clause 6 of these terms, there is no fee payable for collections from England and Wales. Collections from Scotland are subject to a £500+VAT fee that shall be deducted from any funds paid to you for the vehicle.
  • When we collect or you deliver the vehicle you will provide to us:
  • All keys and other items necessary to fully operate the Car
  • The Car’s service record
  • The Car’s MOT current and previous MOT certificates
  • The Car’s V5 (also known as the log book)
  • The Car’s Audio equipment (factory fitted unless stated otherwise on the Vehicle Purchase Order)
  • Proof of ID (Driving Licence or Passport). This is to prevent fraud. If the vehicle is stolen or any other fraudulent activity is discovered, all information will be passed to the relevant authorities, without exception.
  • Proof of Vehicle Ownership (A copy of bill of sale)
  • Please note - it is the legal responsibility of the Registered Keeper to advise DVLA of the sale of any vehicle. Failure to do this will result in a fine. You should, therefore, notify DVLA using the appropriate section of the registration document or certificate. The section you use will depend on the type of document you hold. We recommended that you take a photocopy and/or proof of postage before sending. Alternatively, this can also be done online at https://www.gov.uk/sold-bought-vehicle.
  • We will take title to the vehicle when and only when we take physical possession of it.
  • If we discover within 7 days of collection or delivery of the vehicle that you have not complied with any of the above conditions we shall treat the contract as having been repudiated by you. We shall return the vehicle to you and seek full repayment of all sums we have paid to you.

9. Use of your Information

  • We will use the information collected about you during the purchase process in accordance with the terms of our Privacy Policy, a copy of which can be found behind the Privacy Policy link on the homepage of our website at www.webuyprestigecar.com

10. Validity

  • If any of these Terms and Conditions of Purchase are unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions of Purchase.

11. No Variation or Representation

  • Other than those provided in these Terms and Conditions of Purchase, nothing said by our employees or sub-contractors shall amount to a variation of these Terms and Conditions of Purchase or give a representation about the nature or quality of our products.

12. Third Party Rights

  • Nothing in these Terms and Conditions of Purchase shall give any person, who is not a party to the contract, any benefit or right to enforce any of the terms of the contract.

13. Governing Law and Jurisdiction

  • These Terms and Conditions of Purchase and the Purchase Contract shall be deemed to have been formed under and shall be governed and interpreted in accordance with English law.

14. Refusal to purchase or value a vehicle

  • We at all times reserve the right to refuse to purchase or value a vehicle without giving a reason.

  • Only minor defects in panel surfaces requiring no conventional body or paint work
  • May have had limited high-quality repairs performed
  • No missing, broken, or damaged parts that require replacement

Interior

  • No missing, broken, or damaged parts that require replacement
  • No cuts, tears, or burns that require repair
  • Shows no signs of wear
  • No noticeable offensive odour

Mechanical

  • Mechanically sound
  • All accessories are operable
  • All fluid levels full and clean

Tyres

  • All match by brand, size and style
  • Near new condition

Windscreen

  • No visible glass damage

GOOD

Exterior

  • Minor chips or scratches in panel surfaces requiring minor conventional body and paint work
  • May require removal of small dents that have not broken the paint using Paintless Dent Repair
  • May have had high quality conventional repairs of cosmetic or light collision damage
  • May require replacement of minor missing or broken part

Interior

  • Clean, showing minimal wear
  • May require replacement of minor missing or broken part
  • No noticeable offensive odour

Mechanical

  • Mechanically sound
  • All accessories are operable
  • Fluids may require service
